Automatic Renewal Service Agreement

1. Acceptance and Modification of Terms of Service

1.1 This Agreement is concluded by and between subscribers and BabyBus's World regarding the entrusted deduction service for automatic renewal provided by BabyBus's World (hereinafter referred to as the "Service"), and describes the rights and obligations of BabyBus's World and subscribers during the use of the Service. "Subscribers" refer to natural persons who have completed all subscription procedures in BabyBus's World and are using the subscription services provided by BabyBus's World in compliance with relevant rules. This Agreement is a prerequisite for subscribers to use the Service provided by BabyBus's World. BabyBus's World has prompted subscribers to read relevant exemption or limitation clauses herein in bold font or highlighted in other reasonable fashions. Both parties acknowledge that the aforesaid clauses do not belong to the "exclusion of liability, enhanced obligations, and exclusion of main rights" clause stipulated in Article 40 of the Contract Law. Both users and BabyBus's World acknowledge the legitimacy and validity of the aforesaid clauses. Unless the subscribers accept the terms of this Agreement, they shall have no right to use the Service. Subscribers' choice to use the Service shall be deemed to agree to be bound by the terms of this Agreement.
1.2 BabyBus's World shall be entitled to modify the Terms of Service at any time. In the event of any change or modification in the Terms of Service, BabyBus's World shall remind subscribers of the modified contents on the relevant pages, and the said modification shall take effect 10 days after the date of the announcement. If any subscriber disagrees with such change or modification, he/she may cancel the automatic renewal service. If the subscriber continues to use the Service, he shall be deemed to have accepted all the changes or modifications.
1.3 Subscribers shall have the corresponding legal capacity and disposing capacity when using the Service, and be able to independently bear legal responsibilities. If they are under the age of 18, they can only use the Service under the guardianship and participation of their parents or other guardians. Their use of the Service shall be deemed to have been approved by their parents or other guardians.

2. Service Description

2.1 The Service is introduced out of subscribers' demand for automatic renewal. On the premise that subscribers have already paid for the subscription service, the Service will help users avoid losses caused by their failure to renew in time due to negligence or other reasons. Subscribers authorize BabyBus's World to, prior to the expiration of the subscription validity period, entrust payment channels to deduct fees for the next billing cycle from third-party payment accounts, bank cards and communication accounts (hereinafter collectively referred to as "Account") bound to subscribers' accounts. The billing cycle includes but not limited to the monthly billing cycle, annual billing cycle, etc. (the same below). Users may choose the billing cycle displayed on Baby Bus World Platform at their discretion. Before using the Service, users shall bind their BabyBus's World accounts with the above accounts to facilitate successful deduction of subscription fees from the above accounts.
2.2 Automatic renewal means that, on the premise of 2.1, BabyBus's World will collect fees for the next billing cycle from the above accounts. Subscribers shall ensure that BabyBus's World can successfully deduct the fees from the above accounts. Where renewal fails due to insufficient deductible balance in the above accounts, subscribers shall bear the responsibility arising therefrom and BabyBus's World shall have the right to interrupt/terminate the corresponding subscription rights and services.
2.3 Where users choose to activate automatic renewal, they shall be deemed to have agreed to authorize BabyBus's World to issue a deduction instruction to the above accounts to deduct the fees for the next billing cycle from the accounts without having to verify the account password, payment password, SMS check code, and other information. Unless subscribers explicitly cancel the automatic renewal service, the automatic deduction entrusted by subscribers to BabyBus's World shall be irrevocable. Except as otherwise stipulated by laws and regulations, BabyBus's World will not refund the fees paid by subscribers in any way.
2.4 Subscribers shall be bound by the terms of the BabyBus's World User Service Agreement, the BabyBus's World Privacy Policy, and all relevant sub-agreements, page descriptions or standard procedures when using the Service. When subscribers use the Service, their usage behavior shall be deemed as their consent to the service terms and all kinds of publicity issued by BabyBus's World concerning the Service. In the event of any conflict between this Agreement and the BabyBus's World User Service Agreement and the BabyBus's World Privacy Policy, this Agreement shall prevail.
2.5 Subscribers shall only use the Service provided by BabyBus's World on BabyBus's World platform. Any service content separated from BabyBus's World platform through malicious cracking or other illegal means shall not be deemed as the Service agreed upon hereunder. All legal consequences arising therefrom shall be the borne by the actor, and BabyBus's World shall pursue legal action against the actor according to law.

3. Rights and Obligations of Both Parties

3.1 BabyBus's World shall be responsible for providing subscribers with inquiry methods about the specific status of automatic renewal, but will not provide invoice printing and/or subscription service forwarding.
3.2 BabyBus's World will deduct the fees for the next billing cycle from the above accounts of subscribers 24 hours prior to the expiration of the valid period, and extend the valid period of subscribers accordingly. Upon successful deduction, BabyBus's World has the right to collect the fees immediately and does not provide refund service.
3.3 In case of any mistake in the deduction process, BabyBus's World and subscribers shall cooperate with each other to identify the reason and each shall bear the losses caused by its own fault. If losses are caused by both parties, both parties shall bear corresponding responsibilities according to their degree of fault; if losses are caused due to the common fault of both parties and their respective faults cannot be distinguished, both parties shall share the responsibility equally.
3.4 BabyBus's World may change or modify relevant service contents, rules and terms of this Agreement according to its business development or technological upgrading, etc., and shall inform users of relevant changes or modifications through publicity on relevant pages of BabyBus's World or other appropriate locations. BabyBus's World shall not be obliged to make separate notice. The above publicity shall be deemed to have been delivered to users from the date when such publicity is made on BabyBus's World platform. In the case of multiple notice methods, the delivery time shall be the earliest one of the above methods. If any subscriber disagrees with such change or modification, he may cancel the Service and stop using it. If the subscriber continues to use the services provided by BabyBus's World, he shall be deemed to have accepted all the changes or modifications.
3.5 Subscribers have the right to choose whether to cancel the Service. If subscribers choose not to cancel the Service, it will be deemed that subscribers agree that BabyBus's World has the right to continuously make irregular deduction attempts according to certain rules. Upon successful deduction, BabyBus's World will open subscription service for subscribers in the next billing cycle.
3.6 In case of any price adjustment made by BabyBus's World prior to/during the automatic renewal period, the current valid price announced on BabyBus's World Platform shall prevail.
3.7 BabyBus's World does not charge any extra fees for users to subscribe to the Service. However, BabyBus's World shall be entitled to decide whether to charge for the Service itself or adjust the automatic renewal period and fees according to business needs or market changes and other reasons and publicize the said adjustment to subscribers on relevant pages.
3.8 Where subscribers renew the subscription within the validity period, the validity period will be extended on the basis of the original service validity period.
3.9 Subscribers acknowledge and agree that the deduction permission authorized to BabyBus's World shall be regarded as the recharging behavior of subscribers themselves. In case of any loss caused to subscribers due to such deduction, users shall not claim any rights or investigate any liabilities against BabyBus's World and its affiliates.

4. Term and Termination of the Agreement

4.1 This Agreement shall take effect when users accept or use the Service and terminate when subscribers terminate the Service/cancel the subscription qualification, unless otherwise announced by BabyBus's World.
4.2 Subscribers have the right to choose to terminate the Service at any time in the user account settings. Upon termination of the Service, BabyBus's World shall stop providing the Service to users.
4.3 The automatic renewal instruction entrusted to BabyBus's World by subscribers remains valid. BabyBus's World will not refund the fees already deducted based on the instruction, and subscribers shall bear relevant responsibilities and losses.
4.4 BabyBus's World has the right to suspend or terminate the Service due to its own business adjustment, price changes, and other reasons. In case of any of the above circumstances, BabyBus's World shall notify subscribers by public announcement.

5. Liability for Breach of Contract

If either party breaches the contract, the observant party has the right to seek compensation or indemnity through the resolution methods agreed upon by both parties.

6. Dispute Resolution and Applicable Law

BabyBus's World and subscribers shall settle disputes arising from the performance of this Agreement through friendly negotiation. If the negotiation fails, either party may bring a lawsuit to the court where BabyBus is located. The interpretation, validity, and implementation of this Agreement shall be governed by the laws of the People's Republic of China.

7. Miscellaneous

7.1 If subscribers have any doubts (including questions, complaints, etc.) concerning this Agreement or the use of the automatic renewal service of BabyBus's World, please contact BabyBus's World through the user feedback portal on the function page. BabyBus's World will reply to subscribers as soon as possible upon receipt of the comments and suggestions.
7.2 The title of this Agreement is for the convenience of reading only and in no event shall affect the meaning or interpretation of any provisions herein.

1.3 يجب أن يتمتع المشتركون بالأهلية القانونية المناسبة والقدرة على التصرف عند استخدام الخدمة، وأن يكونوا قادرين على تحمل المسؤوليات القانونية بشكل مستقل. فإذا كان عمرهم أقل من 18 عامًا، فيمكنهم استخدام الخدمة فقط تحت وصاية ومشاركة والديهم أو الأوصياء الآخرين. ويعتبر استخدامهم للخدمة دليلاً على أنه قد تمت الموافقة على ذلك من قبل والديهم أو الأوصياء الآخرين.

2. وصف الخدمة

2.1 يتم تقديم الخدمة بناءً على طلب المشتركين للتجديد التلقائي. على افتراض أن المشتركين قد دفعوا بالفعل مقابل خدمة الاشتراك، فإن الخدمة سوف تساعد المستخدمين في تجنب الخسائر الناجمة عن عدم التجديد في الوقت المناسب بسبب السهو أو لأسباب أخرى. يصرح المشتركون لـ BabyBus's World، قبل انتهاء فترة صلاحية الاشتراك، بتكليف قنوات الدفع بخصم رسوم دورة الفواتير التالية من حسابات الدفع عن طريق طرف خارجي، والبطاقات المصرفية وحسابات الاتصال (المشار إليها فيما يلي إجمالاً باسم "الحساب") إلى حسابات المشتركين. تتضمن دورة الفواتير على سبيل المثال لا الحصر دورة الفواتير الشهرية، ودورة الفواتير السنوية، وما إلى ذلك (ينطبق الأمر نفسه أدناه). يمكن للمستخدمين اختيار دورة الفواتير المعروضة على منصة Baby Bus World حسب تقديرهم. قبل استخدام الخدمة، يجب على المستخدمين ربط حسابات BabyBus World الخاصة بهم بالحسابات المذكورة أعلاه لتسهيل خصم رسوم الاشتراك بنجاح من الحسابات المذكورة أعلاه.

2.3 عندما يختار المستخدمون تفعيل التجديد التلقائي، يتم اعتبارهم قد وافقوا على تفويض BabyBus's World لإصدار تعليمات خصم للحسابات المذكورة أعلاه لخصم رسوم دورة الفواتير التالية من الحسابات دون الحاجة إلى التحقق من كلمة مرور الحساب، وكلمة المرور الخاصة بالدفع، ورمز التحقق من الرسائل القصيرة، وغيرها من المعلومات. ما لم يقم المشتركون بإلغاء خدمة التجديد التلقائي بشكل صريح، يكون الخصم التلقائي الذي يعهد به المشتركون في BabyBus's World لا رجعة فيه. باستثناء ما تنص عليه القوانين واللوائح بخلاف ذلك، لن يقوم BabyBus's World برد الرسوم التي يدفعها المشتركون بأي طريقة.
2.4 يجب أن يلتزم المشتركون بشروط اتفاقية خدمة المستخدم الخاصة بـ BabyBus's World، وسياسة الخصوصية الخاصة بـ BabyBus's World، وجميع الاتفاقات الفرعية ذات الصلة، وأوصاف الصفحات أو الإجراءات القياسية عند استخدام الخدمة. عند استخدام المشتركين للخدمة، يجب اعتبار سلوك الاستخدام الخاص بهم بمثابة موافقة منهم على شروط الخدمة وجميع أنواع الدعاية الصادرة عن BabyBus's World بشأن الخدمة. في حالة وجود أي تعارض بين هذه الاتفاقية وبين اتفاقية خدمة المستخدم الخاصة بـ BabyBus's Worldوسياسة الخصوصية الخاصة بـ BabyBus's World، تسود أحكام هذه الاتفاقية.
2.5 يجب على المشتركين فقط استخدام الخدمة المقدمة من قبل BabyBus's World على منصة BabyBus's World. أي محتوى للخدمة منفصل عن منصة BabyBus's World نتيجة انتهاك التراخيص أو غير ذلك من الوسائل غير القانونية لا يُعتبر الخدمة المتفق عليها بموجب هذه الاتفاقية. يتحمل الفاعل جميع العواقب القانونية الناشئة عن ذلك، ويتخذ BabyBus's World الإجراءات القانونية ضد الفاعل وفقًا للقانون.

3. حقوق والتزامات الطرفين

3.1 سيكون BabyBus's World مسؤولاً عن تزويد المشتركين بطرق للاستفسار عن الحالة المحددة للتجديد التلقائي، ولكن لن يوفر إمكانية طباعة الفاتورة و/أو إعادة توجيه خدمة الاشتراك.
3.2 سيخصم BabyBus's World رسوم دورة الفواتير التالية من الحسابات المذكورة أعلاه للمشتركين قبل 24 ساعة من انتهاء فترة الصلاحية، وسيمدد فترة صلاحية جديدة للمشتركين وفقًا لذلك. عند الخصم بنجاح، يحق لـ BabyBus's World تحصيل الرسوم على الفور ولا تقدم خدمة استرداد الأموال.
3.3 في حالة وجود أي خطأ في عملية الخصم، يتعاون BabyBus's World والمشتركون مع بعضهم البعض لتحديد السبب ويتحمل كل منهما الخسائر الناجمة عن خطئه. إذا كانت الخسائر ناتجة عن كلا الطرفين، يتحمل كلا الطرفين المسؤوليات ذات الصلة وفقًا لدرجة الخطأ؛ في حالة حدوث خسائر بسبب الخطأ المشترك لكلا الطرفين ولا يمكن التمييز بين أخطاء كل منهما، يتحمل كلا الطرفين المسؤولية بالتساوي.
3.4 قد يقوم BabyBus's World بتغيير أو تعديل محتويات الخدمة ذات الصلة، وقواعد وشروط هذه الاتفاقية وفقًا لتطور أعمالها أو التقدم التكنولوجي، وما إلى ذلك، ويجب عليها إعلام المستخدمين بالتغييرات أو التعديلات ذات الصلة من خلال الدعاية على الصفحات ذات الصلة من BabyBus's World أو المواقع المناسبة الأخرى . لا يلزم BabyBus's World تقديم إشعار منفصل. يُعتبر الإعلان أعلاه قد تم تسليمه للمستخدمين من تاريخ نشر هذا الإعلان على منصةBabyBus's World. في حالة وجود طرق متعددة للإشعار، يكون وقت التسليم هو الأقرب من الوسائل المذكورة أعلاه. إذا لم يوافق أي مشترك على هذا التغيير أو التعديل ، فيجوز له إلغاء الخدمة والتوقف عن استخدامها. إذا استمر المشترك في استخدام الخدمات المقدمة من BabyBus's World، فسيُعتبر قد قبل جميع التغييرات أو التعديلات.
3.5 يحق للمشتركين اختيار إلغاء الخدمة. إذا اختار المشتركون عدم إلغاء الخدمة، فسيتم اعتبار أن المشتركين قد وافقوا على أن BabyBus's World لها الحق في إجراء محاولات خصم غير منتظمة باستمرار وفقًا لقواعد معينة. بعد الخصم بنجاح، سيفتح BabyBus's World خدمة الاشتراك للمشتركين في دورة الفواتير التالية.
3.6 في حالة حدوث أي تعديل في الأسعار من قِبل BabyBus's World قبل أو خلال فترة التجديد التلقائي، يسود السعر الحالي الساري المعلن على منصة BabyBus's World.
3.7 لا يفرض BabyBus's World أي رسوم إضافية على المستخدمين للاشتراك في الخدمة. ومع ذلك، يحق لـ BabyBus's World تحديد ما إذا كان سيتم فرض رسوم على الخدمة نفسها أو ضبط فترة التجديد التلقائي والرسوم وفقًا لاحتياجات العمل أو تغييرات السوق وأسباب أخرى ونشر التعديل المذكور للمشتركين على الصفحات ذات الصلة.
3.8 عندما يجدد المشتركون الاشتراك خلال فترة الصلاحية، سيتم تمديد فترة الصلاحية على أساس فترة صلاحية الخدمة الأصلية.
3.9 يقر المشتركون ويوافقون على أن إذن الخصم الممنوح لـ BabyBus's World سوف يُعتبر سلوك إعادة فرض الرسوم على المشتركين أنفسهم. في حالة حدوث أي خسارة للمشتركين بسبب هذا الخصم، لا يجوز للمستخدمين المطالبة بأي حقوق أو التحقيق في أي التزامات ضد BabyBus's World والشركات التابعة لها.

4. مدة الاتفاقية وإنهائها

4.1 تصبح هذه الاتفاقية سارية المفعول عندما يقبل المستخدمون الخدمة أو يستخدمونها وتنتهي عند قيام المشتركين بإنهاء الخدمة/إلغاء الاشتراك، ما لم يعلن BabyBus's World عن غير ذلك.
4.2 يحق للمشتركين اختيار إنهاء الخدمة في أي وقت من خلال إعدادات حساب المستخدم. عند إنهاء الخدمة، سوف تتوقف BabyBus's World عن تقديم الخدمة للمستخدمين.
4.3 لا تزال تعليمات التجديد التلقائي التي عهد بها المشتركون إلى BabyBus's World صالحة. لن يقوم BabyBus's World برد الرسوم التي تم خصمها بالفعل بناءً على التعليمات، ويتحمل المشتركون المسؤوليات والخسائر ذات الصلة.
4.4 لدى BabyBus's World الحق في تعليق الخدمة أو إنهائها بسبب تعديل الأعمال الخاصة بها، وتغيرات الأسعار، وغيرها من الأسباب. في حالة وجود أي من الظروف المذكورة أعلاه، يجب على BabyBus's World إبلاغ المشتركين بإعلان عام.

5. مسؤولية مخالفة العقد

إذا خرق أي من الطرفين العقد، يحق للطرف الملتزم المطالبة بالبدل أو التعويض من خلال أساليب التسوية المتفق عليها بين الطرفين.

6. حل النزاعات والقانون المطبق

يجب على BabyBus's World والمشتركين تسوية النزاعات الناشئة عن أداء هذه الاتفاقية من خلال المفاوضات الودية. إذا فشلت المفاوضات، يجوز لأي من الطرفين رفع دعوى إلى المحكمة التي تقع BabyBus تحت سلطتها. يخضع تفسير وصلاحية وتنفيذ هذه الاتفاقية لقوانين جمهورية الصين الشعبية.

7. أمور متنوعة

7.1 إذا كان لدى المشتركين أي شكوك (بما في ذلك الأسئلة والشكاوى وما إلى ذلك) فيما يتعلق بهذه الاتفاقية أو استخدام خدمة التجديد التلقائي لـ BabyBus's World، فيرجى الاتصال بـ BabyBus's World من خلال بوابة ملاحظات المستخدمين على صفحة المهام. سيرد BabyBus's World على المشتركين في أسرع وقت ممكن عند استلام التعليقات والاقتراحات.
7.2 إن عنوان هذه الاتفاقية للقراءة فقط ولن يؤثر بأي حال من الأحوال على معنى أو تفسير أي من الأحكام الواردة في الاتفاقية.

自動更新サービス契約書

1. サービス利用規約の承認と変更

1.1 この契約書は、BabyBus's Worldが提供する自動更新のための委託された差し引きサービスに関して（以下「サービス」とする）会員とBabyBus's Worldの間で締結され、サービスの利用期間における、BabyBus's Worldと会員の権利と義務について説明する。「会員」とはBabyBus’s Worldの購読手続きをすべて完了させ、関連する規則を守ってBabyBus's Worldの購読サービスを使用している自然人である。この契約は、会員がBabyBus's Worldが提供するサービスを使用するための必須となる条件である。BabyBus's Worldは、関連する免責条項または制限条項を太字で、または他のしかるべき方法で強調して会員に対して読むよう推奨している。両当事者は、前述の条項は、契約法第40条に規定されている「責任の除外、義務の強化、および主要な権利の除外」条項に属していないことを承諾する。ユーザーとBabyBus’s Worldは、前述の条項の正当性と有効性を認める。会員が本契約の条件に同意しない限り、サービスを使用する権利はないものとする。本サービスを利用する会員の選択は、本契約の条件に同意するものとみなされる。
1.2 BabyBus's Worldは、いつでも利用規約を変更する権利を持つ。サービス利用規約の変更または修正が行われた場合、BabyBus's Worldでは、会員に対して関連ページの変更された内容を通知し、当該変更は、その公表がされた日の10日後以降その効力を生ずる。会員は、その変更または修正に同意しないときは、彼/彼女は自動更新サービスを解約できる。会員が本サービスを継続して利用する場合、会員はすべての変更または修正を承諾したものとみなされる。
1.3 会員は、本サービスを利用するにあたり、相応の法的能力および財産処分能力を有し、単独で法的責任を負うことができるものとする。18歳未満の方は、父母またはその他の保護者の後見と関与のもとに利用できるサービスだけを利用できる。未成年者の本サービスの利用については、父母または保護者の承諾があったものとみなされる。

2. サービスの説明

2.1 本サービスは、会員が自動更新を望んだことから導入されたものである。本サービスでは、会員がすでに購読サービスに料金を支払っていることを前提として、ユーザーが、過失またはその他の理由により、期限内に更新を行わなかったことに起因する損失を防ぐのに役立つ。会員は、BabyBus's Worldの契約有効期間が満了する前に、次の請求サイクルまでの料金を、会員の口座に紐づけられている第三者の支払い口座、銀行カード、通信口座(以下「アカウント」と総称する)から差し引く支払い経路をBabyBus's Worldに委託することを許可する。請求サイクルには、月次請求サイクル、年次請求サイクルなどが含まれるが、これらに限定されないものとする(以下同じ)。Baby Bus Worldのプラットフォームに表示される請求サイクルを、ユーザーが自由に選択できる。サービスを利用する前に、上記のアカウントから正常に購読手数料を差し引くことを円滑にするために、ユーザーはBabyBus's Worldのアカウントを上記アカウントに連携する必要がある。
2.2 自動更新とは2.1項目の前提により、BabyBus’s Worldが上記のアカウントから次回の請求サイクルのため手数料を集めるというものである。会員はBabyBus's Worldは正常に上記アカウントから手数料を差し引いているか確認する。上記アカウントに差し引きに十分な預金がなくて、更新がうまくいかなかったら、会員はそのことで生じる責任を負い、BabyBus's Worldは相当の会員権とサービスを中断/解除する権利を持つものとする。
2.3 ユーザーが自動更新を有効にした場合、BabyBus’s Worldが上記のアカウントに対して、アカウントのパスワード、支払いパスワード、SMS確認コードおよび他の情報を検証することなしに、アカウントから次回の請求サイクルの手数料を差し引くために、差し引きの指示を発行することを認めたことを同意するものとみなされる。会員がはっきりと自動更新サービスの解約をしない限り、会員によってBabyBus's Worldに委託された自動差し引きは取り消しできないものとする。法と規約によって他に規定がない場合、BabyBus's Worldはいかなる方法であっても会員によって支払われた手数料を返金しないものとする。
2.4 会員はサービスの利用にあたって、BabyBus's Worldユーザーサービス利用規約の条件、BabyBus’s World個人情報保護指針、およびすべての関連するサブの合意、ページの説明または標準的な手順に従うものとする。会員がサービスを利用した時点で、本サービスに関連してBabyBus's Worldによって発行された、サービス条件およびすべての発行された内容に同意があったものだとみなされる。本契約書とBabyBus's Worldユーザーサービス利用規約の条件およびBabyBus’s World個人情報保護指針の内容に矛盾が生じた場合は、本契約書が優先されるものとする。
2.5　会員はBabyBus's Worldのプラットフォーム上でBabyBus's Worldによって提供されるサービスのみを利用できるものとする。悪意のあるハッカーまたは他の違法な手段を介してBabyBus's Worldのプラットフォームから分離されたサービスコンテンツは、本契約で同意したサービスとはみなされない。そこから起きるすべての法的な因果関係の責任は当事者にあり、BabyBus's Worldは法に従いその当事者を法的な手段によって追及するものとする。

3. 双方の当事者の権利と義務

3.1　BabyBus's Worldは、自動更新の特定の状況に関して、問い合わせ方法により会員に提供する責任がある。しかし印刷した請求書の提供および/または転送した購読サービスの転送は行わないものとする。
BabyBus's Worldは有効期間が切れる24時間前までに、会員の上記のアカウントより次回請求サイクルのため手数料を差し引き、会員の有効期間をそれに応じて延長する。差し引きがうまくいけば、BabyBus's Worldはすぐに手数料を集める権利があり、サービスの返金は行わない。
3.3 差し引きプロセスに何等かのミスが生じた場合は、BabyBus's Worldと会員は原因を特定するため、相互に協力しあうものとする。そして各自が原因で生じた損失を負担する。双方の当事者によって損失が起きた場合は、双方の当事者は、各自の落ち度の度合いに従って、相応する責任を負う。損失が、双方の当事者のよくある失敗によるものである場合、および各自の失敗の区別がつかないのであれば、双方の当事者は、ひとしくその責任を負う。
3.4 BabyBus's Worldは、その業務の発展や技術のアップグレードによって、関連するサービスコンテンツや、本契約の規則や条件を変更または修正することができる。そして、BabyBus's Worldの関連ページの周知や他の適切な所在地を介して、関連する変更または修正をユーザーに通知しなくてはならない。BabyBus’s Worldは別個の通知を作成する義務はないものとする。上記の周知は、BabyBus's Worldプラットフォームで公開された日時にユーザーに届いたものだとみなされる。複数の通知方法がある場合は、届いた時間は、それら上記の方法の中で最も早いものとする。そうした変更または修正に会員が納得できない場合は、会員はサービスを解約して使用を中止できる。会員がBabyBus's Worldによって提供されるサービスの使用を続けているのなら、当該会員はすべての変更または修正に承諾したものだとみなされる。
3.5　会員はサービスを解約するかどうか選ぶ権利がある。会員がサービスの解約を選ばなかった場合、特定の規則に従って、BabyBus's Worldが引き続き不定期な差し引きを試みる権利があることを会員が同意したものだとみなされる。正常な差し引きがあれば、BabyBus's Worldは次の請求サイクルにおいて、会員のための購読サービスを開く。
3.6 BabyBus’s Worldが価格調整を行う場合（自動引き落とし期間の先に/期間中に）BabyBus's Worldが発表した現在有効な価格のほうが優先される。
3.7 BabyBus's Worldはサービスを購読するユーザーに対して、それ以上の手数料の請求はしないものとする。しかし、BabyBus's Worldは、業務上の必要性または市場の変化および他の理由によって、サービスそれ自体に課金するかどうか、また自動更新期間と手数料を調整するかどうかを決定する権利があるものとし、関連するページで会員に当該調整について周知する。
3.8　会員が有効期間内に購読を更新した場合、有効期間は当初のサービスの有効期間を元にして延長される。
3.9 会員はBabyBus's Worldに対して認可された差し引きの許可は会員自身の再度請求する行為であるとみなされることを承認し同意する。そうした差し引きが原因で、会員に対していかなる損失が発生しようともユーザーは、BabyBus's Worldとその提携企業に対して、いかなる権利も主張せず、いかなる義務も調査しないものとする。

4. 契約の期間と解除

4.1 この契約は、BabyBus's Worldが他に発表していない限りは、ユーザーがサービスを承認または使用した時点から有効となり、会員がサービスを解除したり、会員資格を解約した時点で解除されるものとする。
4.2 会員は、ユーザーアカウント設定にていかなる時もサービスの解除を選ぶ権利がある。サービスの解除において、BabyBus's Worldはユーザーに対するサービスの提供を停止する。
4.3　会員からBabyBus's Worldに委託された自動更新指示は有効なままである。BabyBus's Worldは、指示にある通り、すでに差し引かれた手数料は返金しないし、会員は関連する責任と損失を負う。
4.4　BabyBus's Worldは、それ自身の業務上の調整、価格変更、および他の理由が原因で、サービスを一時停止または解除する権利を持つ。上記のような事情がある場合は、BabyBus's Worldは会員に公示により周知をかける必要がある。

5. 契約違反に対する法的責任

もしいずれかの当事者が契約に違反した場合、順守している当事者は、両当事者によって同意をえた解決方法によって、補償や損害賠償を得ようとする権利がある。

6. 紛争解決と準拠法

BabyBus's Worldと会員は、友好的な交渉により、この契約の履行から起こる紛争を解決するものとする。交渉が失敗に終わった場合は、BabyBusの所在地にある裁判所で訴訟を提起するものとする。この契約の解釈、妥当性、および実行は中華人民共和国の法律に準拠する。

7. 雑則

7.1　会員がこの契約や、BabyBus's Worldの自動更新サービスの使用に関係する不明点がある場合は（質問や苦情も含む）、機能ページのユーザーフィードバックポータルを介して、BabyBus’s Worldにお問い合わせください。BabyBus's Worldは、コメントやご指摘を受け取り次第、すぐに会員に対して返信をいたします。
7.2　本契約のタイトルは、読む際の便宜のみであり、本契約のいかなる条項の意味や解釈にも影響を与えないものとする。

Acuerdo de renovación automática de servicio

1. Aceptación y modificaciones de las Condiciones de servicio

1.1 Este Acuerdo se celebra entre los suscriptores y BabyBus's World respecto del servicio de deducción encargada para la renovación automática proporcionada para BabyBus's World (en lo sucesivo, el "Servicio") y describe los derechos y las obligaciones de BabyBus's World y de los suscriptores durante el uso del servicio. "Suscriptores" hace referencia a las personas naturales que hayan completado todos los procedimientos de suscripción en BabyBus's World y utilicen los servicios de suscripción proporcionados por BabyBus's World en cumplimiento de las normas pertinentes. Este Acuerdo es un requisito previo para el uso del Servicio prestado por BabyBus's World de parte de los suscriptores. BabyBus's World ha solicitado a los suscriptores que lean las cláusulas de limitación o exención pertinentes que figuran en el presente documento en negrita o destacadas de otras maneras razonables. Ambas partes reconocen que las cláusulas mencionadas anteriormente no pertenecen a la cláusula de "exención de responsabilidad, obligaciones mejoradas ni exclusión de derechos principales" estipulada en el Artículo 40 de la Ley de Contratos. Tanto los usuarios como BabyBus's World reconocen la legitimidad y la validez de dichas cláusulas. Excepto que los suscriptores acepten las condiciones de este Acuerdo, no tendrán derecho a usar el Servicio. La elección de los suscriptores de usar el Servicio se considerará como una aceptación de cumplimiento de las condiciones de este Acuerdo.
1.2 BabyBus's World tendrá derecho a modificar las Condiciones de servicio en cualquier momento. Ante cambios o modificaciones de las Condiciones de servicio, BabyBus's World recordará a los suscriptores el contenido modificado en las páginas pertinentes, y dichas modificaciones entrarán en vigor diez días después de la fecha del anuncio. Si un suscriptor estuviera en desacuerdo con dicho cambio o modificación, podrá cancelar el servicio de renovación automática. Si el suscriptor continúa usando el Servicio, se considerará que ha aceptado todos los cambios y modificaciones.
1.3 Los suscriptores tendrán la capacidad legal y de disposición correspondiente al usar el Servicio, y podrán asumir responsabilidades legales de manera independiente. Si son menores de 18 años, solo podrán usar el Servicio bajo la tutela y participación de los padres u otros tutores. Su uso del Servicio se considerará aprobado por sus padres u otros tutores.

2. Descripción del servicio

2.1 El Servicio se introduce a partir de la demanda de los suscriptores de la renovación automática. Bajo la premisa de que los suscriptores ya han abonado el servicio de suscripción, el Servicio ayudará a los usuarios a evitar pérdidas provocadas por su falta de renovación oportuna debido a negligencia u otros motivos. Los suscriptores autorizan a BabyBus's World a que, antes del vencimiento del período de validez de la suscripción, encarguen a los canales de pago de confianza la deducción de las comisiones del siguiente ciclo de facturación de cuentas de pago de terceros, tarjetas bancarias o cuentas de comunicación (en lo sucesivo, se denominan "Cuenta" de manera conjunta) vinculadas a las cuentas de los suscriptores. El ciclo de facturación incluye, entre otros, el ciclo de facturación mensual, el ciclo de facturación anual, etc. (el mismo a continuación). Los usuarios pueden elegir el ciclo de facturación que se muestra en la plataforma de Baby Bus World a su entera discreción. Antes de usar el Servicio, los usuarios vincularán sus cuentas de BabyBus's World con las cuentas especificadas anteriormente para facilitar la deducción correcta de las comisiones de suscripción de las cuentas especificadas anteriormente.
2.2 La renovación automática significa que, bajo la premisa de 2.1, BabyBus's World cobrará comisiones por el siguiente ciclo de facturación de las cuentas especificadas. Los suscriptores garantizarán que BabyBus's World pueda deducir correctamente las comisiones de las cuentas especificadas. En caso de que la renovación no se realice correctamente debido a que el saldo deducible en las cuentas especificadas es insuficiente, los suscriptores asumirán la responsabilidad resultante y BabyBus's World tendrá el derecho de interrumpir o finalizar los derechos y servicios de suscripción correspondientes.
2.3 Si los usuarios eligieran activar la renovación automática, se considerará que han aceptado autorizar a BabyBus's World a emitir una instrucción de deducción a las cuentas especificadas para deducir las comisiones del siguiente ciclo de facturación de las cuentas sin necesidad de verificar la contraseña de la cuenta, la contraseña de pago, el código de verificación por SMS u otra información. Excepto que los suscriptores explícitamente cancelen el servicio de renovación automática, la deducción automática encargada por los suscriptores a BabyBus's World será irrevocable. Excepto estipulaciones en contrario de leyes o normativas, BabyBus's World no reembolsará las comisiones abonadas por los suscriptores de ningún modo.
2.4 Los suscriptores estarán vinculados por las condiciones del Acuerdo de servicio del usuario de BabyBus's World, la Política de Privacidad de BabyBus's World y todos los subacuerdos, descripciones de páginas o procedimientos estándares pertinentes al usar el servicio. Cuando los suscriptores utilicen el Servicio, su comportamiento de uso se considerará como consentimiento de las condiciones de servicio y de todo tipo de publicidad emitida por BabyBus's World respecto al Servicio. En caso de que surgiera un conflicto entre este Acuerdo y el Acuerdo de servicio del usuario de BabyBus's World y la Política de Privacidad de BabyBus's World, este Acuerdo prevalecerá.
2.5 Los suscriptores únicamente utilizarán el Servicio prestado por BabyBus's World en la plataforma de BabyBus's World. El contenido de servicio independiente de la plataforma de BabyBus's World a través de intrusiones maliciosas u otros medios ilegales no se considerará un Servicio acordado en virtud de este Acuerdo. Todas las consecuencias legales que surjan de dicho acto serán responsabilidad del actor, y BabyBus's World entablará acciones legales contra el actor conforme a la ley.

3. Derechos y obligaciones de ambas partes

3.1 BabyBus's World será responsable de proporcionar a los suscriptores métodos de consulta sobre el estado específico de la renovación automática, pero no brindará facturas impresas ni reenvíos del servicio de suscripción.
3.2 BabyBus's World deducirá las comisiones del siguiente ciclo de facturación de las cuentas especificadas anteriormente de los suscriptores 24 horas antes del vencimiento del período de validez, y extenderá dicho período de los suscriptores según corresponda. Después de la deducción correcta, BabyBus's World tendrá el derecho de cobrar las comisiones inmediatamente y no brindar un servicio de reembolso.
3.3 En caso de errores en el proceso de deducción, BabyBus's World y los suscriptores cooperarán mutuamente para identificar el motivo, y cada parte asumirá las pérdidas provocadas por su propia culpa. Si las pérdidas son provocadas por ambas partes, ambas asumirán las responsabilidades correspondientes según el grado de culpa; si las pérdidas son provocadas por la culpa en común de ambas partes y no es posible distinguir los respectivos grados, ambas serán responsables en igual medida.
3.4 BabyBus's World puede cambiar o modificar los contenidos, las normas o las condiciones pertinentes del servicio de este Acuerdo según su desarrollo comercial o actualizaciones tecnológicas, etc., e informará a los usuarios sobre los cambios o modificaciones pertinentes mediante publicidad o páginas relevantes de BabyBus's World u otras ubicaciones adecuadas. BabyBus's World no estará obligado a dar una notificación por separado. La publicidad especificada anteriormente se considerará entregada a los usuarios desde la fecha en que se entregue en la plataforma de BabyBus's World. En caso de varios métodos de notificación, el plazo de entrega será el que ocurra primero. Si un suscriptor estuviera en desacuerdo con dicho cambio o modificación, podrá cancelar el Servicio y dejar de utilizarlo. Si el suscriptor continúa usando los servicios prestados por BabyBus's World, se considerará que ha aceptado todos los cambios o modificaciones.
3.5 Los suscriptores tienen el derecho de elegir si desean cancelar el Servicio. Si los suscriptores eligen no cancelar el Servicio, se considerará que los suscriptores aceptan que BabyBus's World tiene el derecho de realizar intentos irregulares de deducción continuamente según determinadas normas. Después de la deducción correcta, BabyBus's World pondrá a disposición el servicio de suscripción para los suscriptores en el siguiente ciclo de facturación.
3.6 En caso de que BabyBus's World realice ajustes en el precio antes o durante el período de renovación automática, el precio válido actual anunciado por la plataforma de BabyBus's World prevalecerá.
3.7 BabyBus's World no cobra comisiones adicionales a los usuarios por su suscripción al Servicio. Sin embargo, BabyBus's World tendrá derecho a decidir si cobrar por el Servicio en sí mismo o ajustar el período y las comisiones de la renovación automática según sus necesidades comerciales o los cambios del mercado y otros motivos, y publicitar dicho ajuste para los suscriptores en las páginas pertinentes.
3.8 Cuando los suscriptores renueven la suscripción dentro del período de validez, dicho período se extenderá en función del período de validez original del servicio.
3.9 Los suscriptores reconocen y aceptan que el permiso de deducción autorizado a BabyBus's World se considerará como el comportamiento de recarga de los suscriptores. En caso de pérdidas provocadas a los suscriptores a causa de dicha deducción, los usuarios no reclamarán derechos ni investigarán responsabilidades contra BabyBus's World y sus afiliados.

4. Plazo y finalización del Acuerdo

4.1 Este Acuerdo entrará en vigencia cuando los usuarios acepten o usen el Servicio, y finalizará cuando los suscriptores finalicen el Servicio o cancelen la calificación de suscripción, excepto que BabyBus's World anuncie lo contrario.
4.2 Los suscriptores tienen el derecho de elegir finalizar el Servicio en cualquier momento desde los ajustes de la cuenta de usuario. Después de la finalización del Servicio, BabyBus's World dejará de prestar el Servicio a los usuarios.
4.3 La instrucción de renovación automática encargada a BabyBus's World por parte de los suscriptores continuará siendo válida. BabyBus's World no reembolsará las comisiones ya deducidas en función de la instrucción, y los suscriptores asumirán las responsabilidades y pérdidas pertinentes.
4.4 BabyBus's World tendrá el derecho de suspender o finalizar el Servicio debido a sus propios ajustes comerciales, cambios de precios y otros motivos. En caso de que se produjera cualquiera de estas circunstancias, BabyBus's World notificará a los suscriptores mediante un anuncio público.

5. Responsabilidad por incumplimiento de contrato

Si alguna de las partes incumpliera el contrato, la otra parte tendrá el derecho de solicitar compensación o indemnización a través de los métodos de resolución acordados por ambas partes.

6. Resolución de conflictos y derecho aplicable

BabyBus's World y los suscriptores dirimirán los conflictos que surjan del desempeño de este Acuerdo mediante negociaciones amistosas. Si las negociaciones fallan, cualquiera de las partes podrá entablar una demanda en los tribunales donde está ubicado BabyBus. La interpretación, validez e implementación de este Acuerdo estarán regidas por la legislación de la República Popular de China.

7. Disposiciones varias

7.1 En caso de dudas de los suscriptores (incluidas preguntas, quejas, etc.) respecto de este Acuerdo o el uso del servicio de renovación automática de BabyBus's World, comuníquese con BabyBus's World mediante el portal de comentarios de usuarios en la página de funcionamiento. BabyBus's World responderá a los suscriptores lo antes posible después de la recepción de los comentarios y sugerencias.
7.2 El título de este Acuerdo es solo para fines de lectura y en ningún caso afectará el significado ni la interpretación de las disposiciones del presente documento.
